The Palermo Assize Court of Appeal acquitted the former officers of the Ros Mario Mori, Antonio Subranni and Giuseppe De Donno and Senator Marcello Dell'Utri at the trial on the so-called State-Mafia negotiation, accused of threatening the State Political Body .

In the first instance they had all been sentenced to very severe penalties.



    The accusations against the repentant Giovanni Brusca have been declared prescribed.

The conviction of the mafia boss Nino Cinà confirmed.  

For Bagarella, the judges re-qualified the offense as an attempted threat to the Political Body of the State, declaring the charges partially prescribed. This resulted in a slight reduction in the sentence passed from 28 to 27 years. Confirmed the 12 years in Cinà. The former officers of the Ros Mario Mori, Antonio Subranni and Giuseppe De Donno were acquitted with the formula because the "fact does not constitute a crime", while Dell'Utri "for not having committed the fact". The prescription of the accusations against the repentant Giovanni Brusca has been confirmed. The appeal, during which the trial was reopened, began on April 29, 2019. During the trial, another defendant, Massimo Ciancimino, son of the former mafia mayor of Palermo Vito,who responded with aggravated slander to former police chief Gianni De Gennaro and participation in mafia association.

Representing the accusation in the courtroom were the deputy attorneys general Giuseppe Fici and Sergio Barbiera who asked for confirmation of the first instance sentence. At the end of the first trial, the Court of Assizes had inflicted 28 years on Bagarella, 12 on Dell'Utri, Mori, Subranni and Cinà and 8 on De Donno and Ciancimino. The charges against the repentant Giovanni Brusca were then declared prescribed. On trial, but for the crime of perjury, the former interior minister Nicola Mancino was also finished and was acquitted. The prosecutor did not appeal and therefore the acquittal became definitive. Finally, for the so-called negotiation, the former DC Minister Calogero Mannino was tried separately and acquitted, in abbreviated form. "Men of the institutions, deviant institutional apparatuses of the state,they entered into an illicit and illegitimate dialogue with the top members of the Cosa Nostra to stop the massacre strategy.

The celebration of this judgment has further proved the existence of an unconfessable truth, of a truth that is within the State, of the State-Mafia negotiation which, however, does not scrutinize institutional principals and executors because either one is against the Mafia or one is accomplices. There are no alternatives ", said the prosecution during the indictment of the appeal process, at the end of which he requested the confirmation of all the convictions of the first degree. According to the prosecutors, the dialogue that the ROS officers, through the Ciancimino and enjoying institutional coverage, they started with Cosa Nostra during the years of the massacres to interrupt the season of the attacks, he would have strengthened the clans by pushing them to further violent actions against the State.prison concessions would have been made to the mafia detainees at 41 bis and a relief in the action against the mafia. The role of Mori and his followers, after '93, again in the reconstruction of the accusation, would have been assumed by Dell'Utri who in the first instance sentence was defined as a "transmission belt" between the clans and the institutional interlocutors.

"We have never doubted the extraneousness of General Mario Mori and the former officers of the Ros Antonio Subranni and Giuseppe De Donno to the affair for which for years they have been nailed and pointed out as traitors to the state. This sentence obliges us to a radical reading of the narration of recent years. The reform of justice and in particular civil liability are an urgent necessity ".
