Measures to which a third is added, a circular - or rather two - of the Interior Ministry on the possibility for port companies to offer free tampons to their employees

In the first, the head of cabinet of the ministry, to avoid blocking the ports in the event of a high number of employees without the green pass, "recommends" the prefects to "solicit" companies to evaluate the possibility of making available for free the tampons. An ambiguous formula, especially as to who - in case - should pay for the tests, which requested a second circular. Companies "will be able to evaluate, in full autonomy, every possible organizational modality for the purpose of acquiring the green pass by employees without". Should they decide to do so, the cost would therefore be borne by them and not by the state. However, the circular opens a case and in fact the unions immediately took advantage of it to ask for the extension of the request to the entire transport sector.

As for the guidelines of the Public Administration - on which there is the go-ahead of the Privacy Guarantor - the Dpcm reiterates that the obligation of the pass (also the paper one) concerns all public employees but also those of cleaning services companies, catering, maintenance and supply of vending machines, consultants, collaborators, attendants of training courses, couriers, visitors. Instead, users are excluded. Those who do not have a pass must be removed immediately and every day of non-service is considered unjustified absence (with holidays and non-working days that are included in the account). The salary is suspended from the first day of absence but "in no case" can you be fired. Furthermore, no contributions or holidays accrue during the period of absence.

What if the absence of the employee results in "an interruption of an essential service"? The administration, says the Dpcm, can establish an agreement with other entities or use internal mobility between offices or different areas. But how do the controls work? They must be done every day, at access to the office or even subsequently, on a carpet or sample basis in a measure of not less than 20% of the staff in service and ensuring a constant rotation. To avoid delays and queues at entry, employers will be able to establish greater flexibility in entry and exit times. For the verifications, the 'VerificationC19' App or the new tools provided by the Dpcm can be used, which will allow a "daily and automated" verificationnoting only the possession of the pass and no high employee data.

It will be possible to integrate the QR code reading system with the turnstiles or with the devices for detecting the temperature already present in the companies and the software will communicate - with an asynchronous interaction - directly with the national platform that issues the green pass: through 'NoiPa '' for public bodies that adhere to this platform or with the INPS portal for employers with more than 50 employees, both public and private, or, finally, with personnel management information systems for those public administrations that have at least one thousand employees . But the Dpcm amending the decree on the obligation to pass also clarifies two other non-secondary aspects: for the employer, public and private, there is "an explicit prohibition"to keep the QR code of the certifications nor is it possible "in any case" to collect employee data "except those strictly necessary" for the application of the sanctions. Furthermore, it will be possible to request the pass in advance from the employee in case of company shifts, but this advance must be "strictly necessary and in any case not exceeding 48 hours".
