'They cannot access work, they lose the right to board and lodging' (ANSA)  "If the caregiver does not have the green pass, she will not be able to access the workplace" and if she is cohabiting "she will have to leave the accommodation" also because the "right of the assisted person to be able to benefit from the assistance without interruption by resorting to another suitable one prevails worker". Three Faqs published today on the Palazzo Chigi website provide for it.

"If the caregiver does not have the green pass, she will not be able to access the workplace" and if she is cohabiting "she will have to leave the accommodation" also because the "right of the assisted person to be able to benefit from the assistance without interruption by resorting to another suitable one prevails worker".

Three Faqs published today on the Palazzo Chigi website provide for it.

"The current legislation provides for the absolute prohibition of moving away from their home or residence for people subjected to the measure of quarantine. If the caregiver is cohabiting, she will clearly not be able to move away from the house in which she lives", writes the government in its Faq. "The national collective agreement provides, for cohabiting carers, that the employer also provides them with food and accommodation or, alternatively, a substitute allowance. In case of suspension due to lack of green pass, the components are also suspended Board and lodging? Will the caregiver then have to leave the accommodation in which they usually live? The board and lodging are services in kind of a remunerative nature so that, in the light of the legal discipline and the correspondence of the domestic work relationship, the non-attribution of the same is correct by virtue of the non-execution of the work consideration ", is the answer to another question." If for five days the caregiver does not provide a valid green pass, the employer can proceed to replace it for 10 days, renewable once? If so, does the caregiver to be replaced live with the employer (or with a family member who benefits from the work), must she leave the accommodation to the substitute? If the caregiver - the government replies - does not have the green pass, she will not be able to access the workplace. The prevailing right of the assisted person to be able to benefit from the necessary assistance without interruption by resorting to another suitable worker remains unaffected. If the caregiver is living with the employer, she will therefore have to leave the accommodation ".

In response to frequently asked questions, the government says that no room and board, in addition to salary, are due to carers without a green certificate.

Furthermore, if the caregiver is cohabiting and positive for Covid, "she will not be able to leave the house in which she lives" for quarantine.

Does the obligation of a Green pass also exist for commercial operators in public areas whose "workplace" is located outdoors?

"Yes. The green pass requirement is not linked to whether the location where you work is outdoors or indoors."

It can be read in one of the Faqs published on the government website.

"The Green pass must be valid when the worker makes the first daily access to the place of employment and can expire during working hours, without the need for its owner to leave".

You can read it in one of the Faq, the answers to frequently asked questions, published on the Palazzo Chigi website, with reference to cases in which the Green pass is issued after taking a swab.

"Who are the subjects entitled to control the companies? The companies will be able to be controlled by the labor inspectors and by the local health companies, which are used by the prefects".

It can be read in one of the Faq, an answer to frequently asked questions, published on the Palazzo Chigi website.

The workers of foreign companies who must access the offices of companies or public administrations in Italy, including road hauliers, must also have and exhibit the green pass.

The updated Faq on the Palazzo Chigi website specify this, remembering that, in the event that the hauliers do not have the certificate, the loading and unloading operations can be carried out by the staff of the Italian company.
