A passenger who flew with the American low-cost carrier Spirit Airlines, claims that Dale offered him free alcohol, asked him to move to a private area on the plane and then sexually assaulted him, according to the lawsuit he filed last week against the airline for $ 150,000.
According to the passenger, whose name was published only in the acronym MB, the airline was negligent.
"The lawsuit was filed to seek justice for our client, who as alleged in our complaint, was sexually assaulted by a flight attendant on a Spirit Airlines flight," Gregory Spicer of VSCP Law in Philadelphia told Insider.
"We look forward to continuing the case in court."
The lawsuit is consistent with an increase in violent incidents on flights, even though most of the harassment on flights is actually directed at the flight attendants' staff.
Last Wednesday, the Federal Aviation Administration (FAA) reported that it received 5,033 reports of reckless passengers in 2021. The FAA opened 950 investigations in 2021, more than five times the 183 investigations it opened in 2020.

The airline "should have known about the flight attendant's propensity for sexual violence"
According to the indictment, Spirit is charged with negligence because the airline "needs to know about the flight attendant's propensity for sexual violence, physical violence and sexual deviation," it said.
However, the lawsuit, which only mentions the flight attendant's first name, did not provide further details about what happened earlier in the flight.
It is unclear whether the steward was called to order earlier during his career, or whether the allegations against him are speculative.
"According to information and belief, Spirit Airlines was unable to perform a thorough background check or reference to the steward," the lawsuit alleges.
"If Spirit Airlines had conducted such an investigation, it would have revealed the concerns raised here."
The airline did not respond to a request for comment.

The MB passenger from Atlanta flew to Philadelphia on June 30 this year to visit family, according to the lawsuit. He sat near the back of the plane, where the flight attendant first gave him a free bottle of water. He then "returned quickly, winked at the passenger and shoved Jack Daniels' vials into his chest," the lawsuit said. A few minutes later the steward placed a folded napkin with his phone number on the passenger's folding table.
As the flight approached Philadelphia, the flight attendant "called for a passenger to reach a private area in the back of the plane behind the toilet," the complaint said. "When the plaintiff approached the back of the plane, the flight attendant looked around and without prior notice grabbed, groped and stroked the plaintiff's penis and private area," the complaint read. The "steward" then tried to unzip the plaintiff's pants. "
In the lawsuit, Spirit was charged with six different counts, including assault, assault and gross negligence in her employment and supervision.
