Observe hygiene rules at the workplace

According to the SARS-CoV-2 occupational health and safety

, every employer must

present

a

hygiene concept in

This regulates what employees have to observe in terms of mask requirements, distance rules and hand disinfection.

There are few specific regulations for employers, but employees are encouraged by the federal government to comply with them.

According to the Corona Occupational Safety and Health Ordinance, employees must be

Can the employer dismiss those who have not been vaccinated?

There is no general obligation to vaccinate against Covid-19 in Germany and it would also be difficult to implement legally.

A

compulsory vaccination for certain professional groups

(such as nurses, doctors or teachers) is always discussed, but so far it has only remained with demands from experts.

The

employee does not have to disclose

the

vaccination status

either.

If a task requires vaccination or recovery, the employer must assign the unvaccinated employee to another job.

According to lawyers, dismissal from unvaccinated persons is therefore only possible in exceptional cases.

No quarantine money for unvaccinated people

For those who

have not

been vaccinated, however, it can be really expensive if they have to be placed in officially ordered quarantine: Since November 1, unvaccinated people who voluntarily refrain from immunization have not been able to continue receiving

wages in the event of quarantine

In Bavaria, 3G is currently valid at the workplace - soon also nationwide?

Some federal states have issued special regulations due to the high number of infections in the 4th wave. In Bavaria, for example, the 3G rule at the workplace * applies to a red clinic traffic light if the company has more than ten employees. In this case, those who have not been vaccinated have to do a corona test twice a week. The same applies to all unvaccinated people with personal contact (exception: public transport and retail). In addition, FFP2 masks are mandatory.

A

nationwide 3G regulation

is currently not planned, but could soon become a reality: According to a report by the German Press Agency, the SPD, Greens and FDP are said to have spoken out in favor of such a regulation during deliberations on a new Corona law (
