According to a court decision, the TV broadcaster of "Bild" should not have shown a longer passage from the "Berliner Runde" from ARD and ZDF on the evening of the federal election in its own program.

At the request of the German Press Agency, the Cologne Regional Court announced on Friday that it had issued a corresponding injunction.

The ZDF had sued.

According to the court, the TV broadcaster "Bild", which belongs to the Axel Springer media group, now has the opportunity to appeal against the decision in the preliminary injunction proceedings.

The »Berliner Runde« is a TV classic on election night.

Top politicians comment on the outcome of the federal election.

The court is of the opinion that the TV broadcaster should have obtained permission to use the passage.

She is no longer allowed to show "picture".

According to the ZDF, the proceedings were about omissions.

The public broadcaster carried out its own procedure.

The ARD has sued elsewhere, as a spokeswoman said on request.

This procedure is still ongoing.

According to the court, the ZDF was not right on all points. While a ban was pronounced for the long broadcast section on the »Berliner Runde«, the responsible chamber did not consider some of the points warned by the ZDF to be fulfilled in a shorter excerpt from an interview, which »Bild« also showed. It is about exploitation issues such as recording. The costs of the proceedings were shared equally between both parties.

A "Bild" spokesman said in response to a dpa request: "We very much welcome that the Cologne Regional Court shares our legal opinion that the use of the ZDF content on the evening of the election by Bild TV was a reporting of a current event that was fundamentally privileged under copyright law." The fact that the use of the »Berlin Round« was supposed to have been too extensive in terms of time is not shared.

"We have not been heard by the Cologne Regional Court on this matter and are considering to appeal against this background."
