Coalition negotiations: Experts want changes to Corona school plans

According to legal experts, the plans of the traffic light parties for schools in the corona crisis must be improved.

This is the only way to really exclude area-wide closings, said Ferdinand Wollenschläger, Professor of Public Law at the University of Augsburg, the dpa news agency.

According to the previous plans, there should no longer be nationwide school closings, but requirements to continue teaching.

But this could lead to difficulties in interpreting the requirements.

Wollenschläger referred to possible distance specifications that could make teaching with full class size impossible, or arrangements for alternating or distance teaching.

If you want to rule out the fact that the classroom operation in schools is suspended, it must be made clear that conditions that limit capacities are not permitted, said Wollenschläger.

Administrative lawyer Hinnerk Wißmann from the University of Munster made a similar statement: The now planned regulation could "be misunderstood and overstretched."

Wißmann therefore recommends an additional formulation that requirements for daycare centers or schools do not »lead to a general limitation of local capacities«.

It is also problematic if, as a result of alternating lessons or the obligation to attend digital lectures, operations at schools and universities are more restricted than in restaurants, for example, added Wissmann.

Teachers' union against compulsory vaccination

Meanwhile, the debate about a possible compulsory vaccination in schools and daycare centers continues - this is also being discussed in the coalition negotiations. Green parliamentary group leader Katrin Göring-Eckardt said on Monday in Berlin that there was still no agreement on mandatory testing in such facilities. But: "We will have to continue talking about such measures with the traffic light partners."

The Education and Science Union (GEW) spoke out again on Tuesday against compulsory corona vaccination for individual professional groups. "The way out of the pandemic is only possible through a high vaccination quota in the entire population and behavior appropriate to the pandemic in order to protect yourself and others," said GEW chairman Maike Finnern to the editorial network Germany (RND). However, the GEW rejects a mandatory vaccination only for selected professions.

Constitutional lawyer Christian Pestalozza, on the other hand, called vaccination compulsory in certain cases.

Pestalozza told the RND with reference to the "fundamental right to health": "If the small relief measures to combat the pandemic are not enough, politicians are even constitutionally obliged to take stricter measures such as mandatory vaccination." even a general compulsory vaccination is permissible.
