Last October a nurse was suspended from the ASL because she refused to be vaccinated as expected for the category.
The labor judge of Velletri, with a precautionary decree of last November 22, ordered her readmission to work for her, an employee of the ASL Roma 6.
In the provision, judge Giulio Cruciani "orders the ASL to immediately relocate the applicant to the Centrale Sats in Marino (center in the province of Rome) and to pay the salary".
In the document, the judge refers to the "constitutional relevance of compromised rights (personal dignity, professional dignity, nutritional role of salary)" adding "that suspension from work can only constitute the last resort and exceptional event in a medium-large company".
"With this order, the court clearly reaffirms the right to work in the face of a suspension that cannot refer to the right to health - says the lawyer David Torriero, defender of women - if it was precisely the decisions of the Government that established that the same is guaranteed through the use of tampons every 48 hours ".
