District court Frankfurt am Main: Circular saw too loud during "Sportschau"

A 71-year-old attacked his neighbor because he was working in the courtyard that evening, and a "wrestling match" ensued. Now the Frankfurt district court decided on compensation for pain and suffering for the victim.

He went to his neighbor wrong because the circular saw during the ARD "Sports Show" was too loud: Because of a violent confrontation after a neighborhood dispute has been sentenced a 71-year-old from the district court of Frankfurt am Main.

Thus, the man has to pay for pain and suffering in the amount of 800 euros and damages.

According to the verdict, the court saw it as proven that he had attacked his 88-year-old neighbor with a club because he was working on the very loud circular saw during the ARD "Sportschau".

The offense was willful bodily harm.

First of all, the 71-year-old, who had previously drunk, is said to have asked his neighbor to stop sawing in the shared courtyard during the Saturday broadcast of the "sports show".

"Wrestling" of seniors

When the 88-year-old still continued to work, the 71-year-old struck according to court with a truncheon on the head of his neighbor and tried to stab him in the eye.

In so incurred "wrestling match" he had bitten his older opponent's ear and twisted nose.

Of the 88-year-old neighbor suffered while bruises on the hip and the left arm and several facial injuries.

Out of consideration for his neighbors, the 88-year-old should have stopped the sawing work for the day or at least interrupted it, the judgment said.

In the opinion of the local court, however, this does not justify the act.

The 88-year-old cannot be accused of complicity either.

The decision is not yet final.
