The Baden-Baden regional court has sentenced a doctor to a suspended sentence of one year for the sexual abuse of two patients in his practice.
The man had taken advantage of the medical relationship of trust and exceeded the limits of treatment, said the presiding judge.
The 56-year-old defendant had denied the allegations and also shook his head during the sentencing.
His lawyer had pleaded for acquittal and announced that he would petition for an appeal against the judgment.
The court considered it proven that the doctor had repeatedly stroked a patient's nipples with his hand as part of osteopathic treatments.
The defendant stimulated another woman after kissing her genital area with his tongue and inserted a finger into her vagina, the judge said.
The person concerned got out of the situation.
She then suffered from insomnia.
No professional ban pronounced
The doctor, on the other hand, argued that osteopathy was treated with bare hands and that patients generally only wore underwear.
Many of the handles recognized in the professional world could be sexualized and misinterpreted.
He also said that he was struggling with racist prejudice.
The man was born abroad and now has German citizenship.
Because one of the women had started the French kiss on her own initiative, the man could have assumed that the woman would also have agreed to further actions, the court now said.
Therefore, the judge refrained from being convicted of rape.
The court also considered a professional ban to be too extensive, as the man had not yet committed a criminal offense.
The verdict corresponds to the pleading of the prosecution.
The doctor also has to pay 20,000 euros to charitable organizations.
