There will be an encore appeal for the two defendants confessed to the injury of the swimmer Manuel Bortuzzo: this was decided by the Cassation which ordered the Court of Appeal of Rome to re-examine the existence or otherwise of the aggravating circumstance of premeditation.
This opens up the possibility of a further penalty discount for Lorenzo Marinelli and Daniel Bazzano, the two young men sentenced for the attempted murder of Manuel to the sentence of 14 years and eight months, reduced on appeal compared to the first degree when the sentence imposed was of 16 years.
The supreme judges therefore accepted one of the defense requests of the two accused, their responsibility remains established.
Bortuzzo was wounded by a gunshot to the back which left him paralyzed.
The shooting took place on the night between 2 and 3 February 2019 in Rome.
