(ANSA) - NEW YORK, 04 JAN - A California judge has wronged Spencer Elden, the man who last year sued Nirvana for using a nude photo of him as a newborn on the cover of the iconic album "Nevermind ". Elden, who was four months old when he was photographed naked for the cover, had sued what remains of the band (surviving members Dave Grohl and Krist Novoselic, Kurt Cobain's widow, Courtney Love, and Kirk Weddle, the photographer of the cover image), stating that the photo, taken when he was just four months old, constituted child pornography and had caused him "extreme and permanent emotional distress" as he grew up. Nirvana's lawyers replied in December claiming that the complaint "lacked merit"and Judge Fernando Olguin has now accepted the request not to proceed. (HANDLE).
