Higher Regional Court in Frankfurt am Main: compensation for accident victims

A woman lost her left arm in an accident with a rental car that was not roadworthy – and is now to receive compensation for pain and suffering.
The Higher Regional Court in Frankfurt am Main has ordered the rental car company responsible to pay 90,000 euros, and the woman should also receive a monthly pension of 160 euros.
The accident happened in the fall of 2010.
The car overturned at high speed due to a defect in the steering column.
The driver suffered very serious injuries.
Revision possible
The judges ruled in the decision published on Monday that it is one of the "cardinal duties" of the landlord to provide a roadworthy car.
In particular, the brakes and steering should be functional.
The company cannot invoke the contractually agreed exclusion of liability for damage through no fault of its own.
The decision is not final, nor can an appeal be made to the Federal Court of Justice.
