Blocking of pornographic sites: the regulator will make its decision “in the coming days”

Arcom has received reports from bailiffs enabling it to establish whether the sites are in compliance with their obligation to verify the age of minors.

On December 13, the regulator of audiovisual and digital media (ex-CSA, which in the meantime has become Arcom) sends an ultimatum to five pornographic sites.

They are ordered to better prevent the access of minors to their platforms, under penalty of being completely blocked in France.

An obligation enshrined in the law against domestic violence voted in 2020.

The Pornhub, Tukif, Xhamster, Xvideo and Xnxx sites initially had two weeks to show their credentials, a process ultimately lengthened by red tape.

But, according to our information, the regulator has just received its findings from bailiffs who determine whether companies are in compliance with the law.

He will decide whether or not to take legal action "

in the coming days

".

Pornhub already compliant

For adult video hosts, adapting to Arcom's guidelines is a headache.

The National Commission for Computing and Liberties (CNIL) has warned against certain age verification methods that may infringe the privacy of users.

A problem that has long blocked the progress of these measures to protect minors.

According to our findings and messages shared by Internet users, only one company has adapted to the regulator's instructions: Pornhub.

Porhub relies on third-party verification systems.

The busiest porn site in the world uses "

service providers specializing in age verification

" and claims not to collect any data.

Users are encouraged to use one of four systems offered: VerifyMyAge, AgeChecked, AuthenticID or Yoti.

These are so-called “

third

-party ” systems that serve as an intermediary between the site and the consumer, with the aim of avoiding a link between the two entities.

A solution put forward by the CNIL in its June 2021 report.

For sites that have not responded to the regulator's requests, a blocking will be requested from a judge.

If it deems Arcom's request legitimate, it will then order Internet service providers to block access to French Internet users.
