The sentence for unintentional murder of Stefano Cucchi against the carabinieri Alessio Di Bernardo and Raffaele D'Alessandro has been reduced by the Supreme Court: the sentence goes from 13 to 12 years in prison.

There will also be a new appeal process for the two carabinieri accused of forgery in the context of the death of Stefano Cucchi.

This was decided by the Supreme Court which reopens the encore appeal for Roberto Mandolini, who had been sentenced to 4 years in prison and for Francesco Tedesco, sentenced to 2 and a half years in prison.

Raffaele D'Alessandro and Alessio Di Bernardo, the two carabinieri sentenced to 12 years by the Supreme Court for the murder of Stefano Cucchi, have surrendered.

Both went to the Ezio Andolfato Barracks in Santa Maria Capua Vetere (Caserta), seat of the judicial military prison.

The two arrived in the middle of the night.

Before being transferred to prison, the two carabinieri handed themselves over to their colleagues who then proceeded to transfer them to the Caserta penitentiary facility.

Ilaria Cucchi said this after the sentence of the Supreme Court that he sentenced two carabinieri to 12 years for the death of his brother.


"Justice has finally arrived after so many years at least against those who beat Stefano causing death."

Cucchi's mother Rita Calore said so.



"We are close to the Cucchi family whose pain we share and to whom we ask to welcome our deep suffering and our regret".

Thus the general command of the carabinieri after the sentence of the Supreme Court which confirmed the sentences for two soldiers, underlining that at this point "the disciplinary proceedings against the two will be promptly concluded, with the utmost rigor".

The sentence, adds the Weapon, "pains us because the ascertained behaviors contradict the values ​​and principles to which those who wear our uniform must always and in any case inspire their actions".

"These are professionally trained subjects who are faced with a predictable reaction, and not even the most striking, during the arrest of Stefano Cucchi who refuses to undergo the photo-signaling" underlined the Pg of the Cassation Tomaso Epidendio in the courtroom, adding that the beating carried out by the carabinieri in the Casilina barracks "it was a corporal punishment of extraordinary gravity, characterized by an evident lack of proportion with the uncooperative attitude of Cucchi".

For this, the Pg asked for confirmation of the aggravating circumstance of the futile reasons for the defendants.
