(ANSA) - MILAN, APRIL 19 - The Supreme Court annulled with postponement to a new section of the Turin Review Court the provision with which last October the appeal of the Verbania Public Prosecutor's Office was accepted and house arrest ordered for Luigi Nerini and Enrico Perocchio, two of the suspects for the tragedy of Mottarone.
On a provision filed this morning, the Supreme Court annulled the decision of the Review against Enrico Perocchio, the operating director of the cableway, limited to the choice of the measure, while it did not pronounce itself on the precautionary needs and on the circumstantial framework which are therefore confirmed.
With regard to Luigi Nerini, the owner of the concession for the plant, the Supreme Court instead annulled the entire provision of the Turin Review.
Now to understand which is the point or points to be re-evaluated, we await the reasons.
Last Friday the hearing was held to discuss the appeal of the defenses against the decision of the Turin judges to overturn the order with which the investigating judge of Verbania Donatella BanciBuonamici on 29 May last had rejected the request for validation of the arrest for the two and for the head of service AndreaTadini, and also the request for a precautionary measure advanced by the Prosecutor's Office except for Tadini, who was placed under house arrest.
On May 26, three days after the tragedy in which 14 people died and only one child, little Eitan, survived, they were stopped by the Prosecutor OlimpiaBossi and prosecutor Laura Carrera, owners of the investigation.
The prosecutors then challenged the provision of the investigating judge and last October the Review had revealed the existence of the security requirements by arranging the house arrest for Nerini and Perocchio.
After that the appeal to the Cassation of the defenses against the order.
Unlike Tadini, who was arrested and then returned free for the term, the two were never subjected to a precautionary measure.
