Mecklenburg-Western Pomerania: court overturns hotspot regulation

The Higher Administrative Court ruled that the entire federal state cannot be a hotspot. In principle, the regulation is legitimate – just not for every virus variant.

No more corona hotspot regulation in Mecklenburg-Western Pomerania: The higher administrative court decided on Friday and overturned the regulation for the federal state.

The court granted an application for temporary legal protection on important points.

In particular, the distance requirement and the obligation to wear a medical mask should therefore no longer apply, a court spokeswoman in Greifswald said.

The state government had already largely lifted the 3G rule (vaccinated, recovered, tested) on Maundy Thursday.

On March 24, the state parliament in Schwerin declared the entire federal state a corona hotspot in order to be able to continue the protective measures in force across the board.

According to the court, the particularly high number of new corona infections and an impending overload of hospital capacities should have been determined individually for each district and city in order to declare them a hotspot.

The judges complained that this did not happen.

Omikron no reason for hotspot regulation

In addition, according to the judges, the spread of a significantly more contagious virus variant required by law can only be assumed if a new variant is found.

The reference to the Omicron variant does not apply because it appeared at the beginning of the year.

In principle, the judges ruled that there was sufficient justification for the hotspot regulation.

If there is a risk of hospital overload due to a particularly high number of new infections, the law allows far-reaching protective measures.

Without the decision of the state parliament, most protective measures under the Federal Infection Protection Act would have ended at the beginning of April - in most federal states they have.

Only Mecklenburg-Western Pomerania and Hamburg declared themselves completely corona hotspots.

In Mecklenburg-Western Pomerania, on the other hand, the AfD parliamentary group went to court.

The hotspot regulation had been decided in Mecklenburg-Western Pomerania to last until April 27th.
