The judges of the Higher Regional Court in Karlsruhe came to the same conclusion.
In this particular case, an insurance company did not want to pay for the damage caused to a car that had become self-employed on a slope.
The owner had no chance and was left with the entire cost.
His problem: He had not pulled the handbrake on his car after parking it on a slope.
A grossly negligent act according to the court.
Judgment 19 U 127/06 states:
"An action is grossly negligent in which, given the overall circumstances, the required care is violated to an unusually high degree and what should have been obvious to everyone in the given situation is ignored"
.
According to the verdict, the road had an approximate gradient of 10 percent at the relevant point.

This makes it clear that the handbrake is important.

In the judgment of the Karlsruhe Higher Regional Court, the driver was explicitly awarded "a gross breach of care" because he had engaged third gear.
