Turnaround in the legal dispute between Eckes-Granini and Edeka: the Cologne Higher Regional Court does not see too much similarity between the containers.

Cologne – After an initial defeat, Edeka has won a stage in the legal dispute against Eckes-Granini.

It's about mimicking the iconic Granini juice bottle.

The Higher Regional Court of Cologne (North Rhine-Westphalia) found a clear difference between the original bottle and the bottle from Edeka's own brand "Albi".

Granini juices in Edeka and Netto: urgent application for Albi bottles

After this statement at the oral hearing this Friday (May 6), Eckes-Granini immediately withdrew the urgent application to stop the advertising and sale of the Albi bottles against Netto Marken-Discount Stiftung & Co KG, a court reporter reported on request the

The dispute has been going on for about a year and a half.

In April it looked as if the two parties would come to an agreement.

Eckes-Granini boss Tim Berger spoke of "very constructive talks" with Edeka.

Edeka vs. Granini: Price dispute between supermarket and juice manufacturer

The whole thing was preceded by a long argument about the prices of the juices from Eckes-Granini at Edeka and its discounter subsidiary Netto.

Granini called for a price increase of six percent because of the huge price increase, higher raw material prices and the shortage of glass and recycled PET for bottles.

Edeka saw things differently and quickly founded their own juice brand called "Albi".

A legal dispute arose over the shape of the bottles.

Eckes-Granini sees the Albi bottles as a copy of the original, Edeka denies that. At the beginning of 2021, the original was right before the regional court: Edeka was not allowed to sell or advertise its new bottles. 

As Lebensmittel Zeitung reports, since this week Netto has had Albi bottles in its range again.

However, their design differs significantly from the bulbous shape of the Granini containers.
