In the view of the Baden-Württemberg tax authorities: marble cake and other sweets at school festivals

Generations of – above all – mothers have made school and summer festivals, open days and club celebrations possible with their baking skills: Selling bakes by parents or pupils is part of everyday life in many educational institutions.
In Baden-Württemberg, however, the sale could be subject to VAT in the future.
This is reported by the "Südwest-Presse".
According to this, the school administration authorities in the state are currently preparing for new regulations for sales taxation of public institutions from 2023.
According to the report, there are already corresponding internal information events for school offices and school authorities.
One of the sticking points: If marble cakes or muffins are sold at the school festival, these sales could become taxable - although the sales proceeds are usually used for class trips, school activities or to support sponsoring associations.
Kretschmann and the cake dispute
According to the "Südwest-Presse", a spokesman for the Ministry of Culture referred to the EU - and said that the changes were unfortunately unavoidable: "For reasons of Union law, the federal government was forced to re-regulate sales tax in the public sector from 2023." As a result, areas that have not previously been considered will also be subject to sales tax in the future.
According to the newspaper, a spokeswoman for the Ministry of the Interior explained that the question of the school festivals was "still being coordinated within the government".
Efforts are being made "to work together on a practicable, low-bureaucracy and legally secure solution".
A change in the planned rules is also being examined in order to possibly exempt bake sales in schools from taxation.
Details also depended on how the bake sale would be specifically designed.
On Tuesday, Prime Minister Winfried Kretschmann even got involved in the cake dispute and promised to cushion the planned regulations: "We will see that their bureaucracy is reduced."
