The judgment enter into the merits of the Haemotronic tragedy of Medolla, where four workers died.

Specifically, judge Michele Cifarelli, of the second civil section, in the 22-page deed treats the deaths of 24-year-old Biagio Santucci and 33-year-old Giordano Visconti, establishing compensation, in favor of relatives who had sued for one and a half million euros .

Approximately one million euros will go to the relatives of Biagio Santucci (to his mother, brothers and other family members) and to those of 33-year-old Giordano Visconti (to his mother and brother) half a million euros.

The Modenese civil court recognizes the responsibility of Haemotronic with respect to the two deaths on the basis of article 2087 of the civil code regarding labor protection.

In fact, the sentence emphasizes the fact that the inspection by an engineer carried out inside the Haemotronic shed after the earthquake of 20 May to verify its practicability could not be sufficient to guarantee a re-evaluation of the risk by the company in the face, in fact, of the shock that had already been recorded in the Modena area and of those that continued to be felt throughout the territory.

"The fact that - writes the judge in this regard - a few days earlier an earthquake with dead and injured occurred in the nearby area, constitutes, with respect to the seismic risk, precisely that fact to which the legislator reconnects the obligation to reassess the risk" .

The judgment of viability, adds judge Cifarelli, "does not represent a safety analysis nor does it replace it (...) it is not of a definitive nature, but temporary; finally, it does not have a precise objective in terms of risks".

Haemotronic, in essence, "is in default of the obligation of prevention, for having allowed the resumption of the activity of the employees inside the shed".

The criminal investigation relating to the four deaths that occurred in the collapse of the Haemotronic in Medolla, where manslaughter was hypothesized, was closed in 2016 and established that, in essence, the company respected the rules of the time, but it was precisely the rules, in 2012, that were not adequate with respect to an event such as an earthquake of that magnitude.

The news of the decision of the civil court of Modena was welcomed by the relatives of the victims: "What I can say for the moment - the words of Anna Cannavacciuolo, mother of Biagio Santucci - is that at least in part justice has been done. is moved ".

Governor Stefano Bonaccini spoke yesterday recalling the great effort made by the whole of Emilia for reconstruction: "We will present to President Mattarella a part of Italy that works well. After 10 years, we have fully rebuilt almost 95% of what was destroyed o unusable due to an earthquake estimated at around 13-14 billion euros in damage is something very important.
