Motorists in Germany can now refer to a ruling by the Federal Court of Justice if it is once again unclear who actually has the right of way in a “lane that is narrowed on both sides”.

Munich – All drivers learn the street signs for their driving test.

Learned quickly, but the knowledge of the traffic rules often fades again very quickly - and the meaning of some signs is not entirely clear anyway.

And also in other traffic situations, the right of way is repeatedly disregarded.

It was the same for a long time with the sign for the “roadway narrowed on both sides”.

The sign actually only indicates that the affected road is narrowing from both sides.

So who has the right of way?

This question has already led to numerous arguments between motorists.

The scenario: Two cars are driving parallel on a two-lane road in the same direction.

Suddenly, the said sign indicates that two lanes narrow into one.

But which car gets to go first?

The Federal Court of Justice has now passed a judgment that provides a little more clarity.

Everyone who drives a car knows the sign "Narrow lane".

But who actually has the right of way in a situation like this?

New priority rule: court appeals to “mutual consideration”

The dispute broke out after an accident in Hamburg in 2018. A truck driving on the left pulled to the right because he did not see the car to the right.

An accident happened.

The driver went to court because she felt right and did not want to share the damage.

The case went through several instances before the Federal Court of Justice made a decision: Both road users are to blame for the accident because the right of way is not regulated when the roadway narrows on both sides.

The “principle of mutual consideration” applies.

"If the agreement does not succeed, they are obliged to give way to the other in case of doubt," says the Federal Court of Justice.

However, the judgment only refers to the traffic sign of a narrowing on both sides.

If the road narrows on only one side, vehicles in the lane that is ending must merge into the lane using the zip method.
