(ANSA) - ROME, MAY 26 - The quarantine imposed on Covid-19 patients does not limit personal freedom but only that of movement.
And it is in no way comparable to arrests or home detention.
This was underlined by the Constitutional Court in the motivations of sentence number 127 (editor AugustoBarbera) with which it excluded the violation of personal freedom and the incrimination of those who leave the house, after a provision of the health authority that forbids it due to the fact that it is susceptible to the virus.
The quarantine, explains the Court, rejecting the complaints made by the court of Reggio Calabria, is a restrictive measure of a general nature, introduced by the law for health reasons; it does not imply any judgment on the moral personality and social dignity of the person who is positive, such as to require the intervention of the judge.
And above all, it does not involve any physical coercion, for those who do not respect it.
