Walking speed is difficult for drivers to assess: there is a lot of leeway in the definition under traffic law.

Everyday life on the road always has unanswered questions for some drivers.

As

echo24.de

reported, it's not just about traffic signs that nobody knows - like the halved car with four figures.

Certain rules on speed are also not always very clear.

How fast is actually walking speed?

And where does it apply?

The traffic sign "when wet" causes a similar amount of uncertainty.

When is a road really considered wet?

As with walking speed, the road traffic regulations (StVO) also leave a lot of leeway here.

How fast is walking speed?

No legal definition for road traffic

As the experts of the

General German Automobile Club (ADAC

) write, among others, there is no exact definition of walking speed in the legal sense:

"The Road Traffic Regulations do not specify any value or amount"

.

But how fast is walking speed?

There have been several judgments in court in the past, which differ widely in definition.

According to the

German catalog of fines

portal , some courts have specified a value of less than 15 km/h, others see walking speed at 7 km/h.

This results in the principle that a value well below 20 km/h is the appropriate recommended speed.

Where does walking speed apply to drivers?

For the implementation of the walking speed, in turn, precise information can also be found in the road traffic regulations.

The

ADAC

has summarized the most important situation:

  • On play streets: traffic-calmed areas with the square, blue and white sign.

  • When a school bus or bus is parked at a designated stop with its hazard warning lights on.

Oncoming traffic must also pass at walking speed.

  • Motor vehicles over 3.5 tons must pay attention to their speed when turning right in built-up areas.

    Especially everywhere

"where bicycle or pedestrian traffic is to be expected"

    .

Federal states define walking speed differently: where what applies

Since the walking speed is not assigned a generally valid value in the StVO, courts always decide on a case-by-case basis.

As an article from stvo2go.de shows, there is also a difference between the individual federal states.

Judgments were collected for the comparison in order to get a corresponding tendency for the respective recommended speed.

The ideal replacement can be found in every refrigerated counter - for less than one euro

  • After several judgments before the Munich Higher Regional Court, the Bavarian Administrative Court and the Munich Administrative Court, Bavaria cannot really come to an agreement.

The values are between 5 and 20 km/h.

  • With judgments before the Karlsruhe Higher Regional Court, Baden-Württemberg is much clearer in the direction of walking speed.

Here you can assume 4 to 7 km/h.

  • North Rhine-Westphalia, like Bavaria, does not come up with a more precise figure - 4 to 15 km/h.

  • Saxony: 15 km/h

  • Saxony-Anhalt: 10 km/h

  • Brandenburg levels off at 5 to 7 km/h if you look at the different court decisions.

Too fast for walking speed?

These fines threaten motorists

Drivers who drove too fast at walking speed must expect a fine.

In case of doubt, however, the amount of the penalty is always determined by a court.

In addition to fines, there can also be points in Flensburg and in some cases driving bans.

According to the catalog of fines, the best way to get away with it is if you “ do not reduce your speed when

entering a traffic-calmed area, but the speed is less than 10 km/h.

Then only a warning of 30 euros follows
