Minimum wage will rise to 12 euros in all sectors from October - but there are exceptions

From October 1st, the statutory minimum wage in Germany will increase from EUR 10.45 to EUR 12.00.
However, this does not apply to everyone.
There is currently a statutory minimum wage of 10.45 euros in Germany – this was last adjusted in July.
From October 2022 there will be another adjustment, then employees will receive 12 euros per hour.
This is the third time the statutory minimum wage has been raised this year.
From October 1st, the statutory minimum wage will increase to 12 euros per hour.
The long-term unemployed or people doing internships do not benefit from this.

Statutory minimum wage: This has been a development over time
The
German Trade Union Confederation (DGB)
has created a scale that illustrates the development of the statutory minimum wage.
The recording starts with the values from eight years ago.

Around 22 percent of all employment relationships are affected
The
Institute for Labor Market and Vocational Research (IAB)
is a research facility of the Federal Employment Agency.
This examines, among other things, the interests of the statutory minimum wage.
According to an estimate by the institute, in 2021 every fifth job was affected by the statutory minimum wage.
Accordingly, the conclusion can be drawn that the increase from October 2022 will also affect many jobs.

These occupational groups are excluded from the minimum wage
However, there are still groups of people and professions who are excluded from the statutory minimum wage.
There are various reasons for this, including whether or not vocational training has already been completed.
Adolescents under the age of 18 who have not completed vocational training
Trainees, regardless of age, receive a minimum training allowance – this differs from the statutory minimum wage
Long-term unemployed during the first six months in their first job after unemployment ends
Internships: if they are school or university internships
Orientation internships up to a duration of three months if the internship is used for career or study orientation
Young people who are taking part in introductory training in preparation for subsequent training
volunteers
Apart from the statutory minimum wage: These industry minimum wages will increase this year
In addition to the statutory minimum wage, there are also industry-specific minimum wages that are negotiated by trade unions and employers in collective agreements.
These are then declared binding by politicians.
The DBG informs that this applies to all employees in the industry, even if the company is not bound by a collective agreement.

Who controls whether the statutory minimum wage is paid?
The Federal Customs Administration’s financial control for undeclared work (FKS) is used as a control body to determine whether the minimum wage is paid to the workforce.
This has already checked the industry minimum wages beforehand.
Datev
, the portal for tax consultants, auditors and lawyers, informs that violations can result in fines of up to 500,000 euros.
