Then you can claim your money back.

The corona pandemic also left its mark on the fitness studios.

Most studios had to close for months due to the Corona measures.

However, many operators continued to charge membership fees despite the inability of customers to train.

In this case you can ask for your money back.

New court ruling: Superfit gym chain has to pay back contributions

Since a ruling by the Federal Court of Justice (BGH) in May 2022 (file number XII ZR 64/21 ), it has already been established that fitness studios are not allowed to debit membership fees from the account if it had to close due to the corona pandemic.

The purpose of the contract simply could not be fulfilled.

Customers who were asked to pay anyway can ask for their money back.

This is now even easier for customers of the SuperFit chain in Berlin and Potsdam: The Federation of Consumer Organizations has filed a model declaratory action against the operator – and won.

These had continued to collect 29.90 euros per month during their 9-month closing period.

The approximately 1,200 SuperFit customers who have registered their rights to legal action are now getting their money back or are safe from claims by the company if they withheld the contributions.

Customers who have not registered their rights with the Federal Office of Justice can still refer to the judgment and, according to

What do those affected have to do to get their money back now?

With reference to the Court of Appeal's judgment, SuperFit customers can reclaim their overpaid contributions by sending a sample letter from the consumer advice center if the chain does not transfer the money on its own.

According to the consumer center, overdue fines or collection costs are also included.

Members of other studios who have had similar experiences should also request their money back with a sample letter that refers to the BGH judgment.

In both cases, set a deadline of 14 days.

Thereafter, default interest of 4.12% will be due and you are entitled to engage a lawyer at the company's expense to enforce your claims.

Incidentally, you do not have to accept vouchers for training times.

Incidentally, contracts from fitness studios can now be terminated much more quickly.
