"Solid" is the reason with which the Turin Review Court, applying house arrest to the engineer Enrico Perocchio (director of
the Mottarone cable car
and employee of Leitner, the maintenance company of the plant which collapsed on May 23, 2021 with 14 deaths ) declared the "danger of recidivism" and the "danger of recurrence" current.
This was underlined by the Supreme Court - verdict 39091 filed today, hearing on April 15 - which orders the re-examination to assess whether "in view of the protection of persistent precautionary requirements" the only temporary prohibition to exercise the profession can be applied.
There is a "mass of convergent preliminary investigation emergencies that attest, on the one hand, that Enrico Perocchio, fully aware like Luigi Nerini, of the problem that has arisen and of the need that, in the absence of a radical maintenance intervention, the plant should work with the emergency brake disengaged, has expressly endorsed this reckless modus operandi and for the other that the tragic events of 23 May 2021 affected a company that had already dealt, in the past, with the conflict between the needs of safety and those of an economic nature ".
The Supreme Court says so in the verdict on Mottarone.
The refusal of the Turin Review Court to accept the defensive brief of Luigi Nerini (holder of the concession for the Mottarone cable car, which collapsed on 23 May 2021 with 14 deaths) in view of the hearing on 28 September 2021, resulted in "the injury of the rights "of the accused and" the violation of the rules governing the motivation of judicial decisions ".
For this strictly 'formal' reason and which does not enter into the merits of the precautionary requirements, the Supreme Court - verdict 39091 filed today, hearing April 15 - canceled the order of the review that had ordered the house arrest.
