Judgment in Berlin: If you park incorrectly too often, you lose your driver's license

Wrong parked 159 times, too fast 15 times, now the "rag" is gone: A Berlin court ruled that a man's driver's license was rightfully revoked. He claimed it wasn't his fault at all.

He was "unsuitable" as a road user because he had parked wrong so often and had driven too fast: The Berlin Administrative Court rejected a man's complaint against the withdrawal of his driver's license by the State Office for Citizens' and Regulatory Affairs.

The verdict from the end of October with the file number VG 4 K 456/21 became known this Monday.

According to the court, the office learned in July 2021 that 174 proceedings for traffic offenses had been conducted against the man within a year.

These included 159 parking violations and 15 speeding violations.

After hearing the plaintiff, the authorities revoked his driver's license.

The man argued that other people committed the offenses with three vehicles registered to him.

He is professionally dependent on the driver's license.

»Character flaws«

The administrative court did not accept this.

The authority rightly assumed that the plaintiff was unsuitable, it said.

It is true that minor violations in road traffic should generally not be taken into account when assessing fitness to drive.

This is different, however, if a motorist is "obviously unwilling" to observe certain regulations in the interests of orderly traffic.

The number of violations, which were almost exclusively committed in the residential area, justifies the doubts about the suitability of the plaintiff.

It is also not important whether family members are responsible for the violations.

The fine notices were sent to the man.

Anyone who finds out that people who use their vehicle are constantly breaking traffic regulations and doing nothing about it is showing “character defects”.

These identified him as an unsuitable road user.

An application for approval of an appeal against the judgment can be filed with the Higher Administrative Court of Berlin-Brandenburg.
