This mistake costs a fine of up to 60 euros.

Winter tires are mandatory in the cold season.

When changing summer and winter tires, a mistake can be very expensive.

After all, if a wheel comes off the car shortly after the tire has been changed, the resulting accident can result in serious damage.

But who is liable in the event of damage?

The district court of Munich II announced a verdict on this last winter - after almost two years of proceedings, reports hna.de.

Driver does not tighten winter tire wheel nuts

A Mercedes driver who had the wheels changed in a workshop had complained.

About 100 kilometers later, the left rear wheel came loose on the freeway.

In the subsequent accident, the car suffered damage of around 13,000 euros, for which the driver's fully comprehensive insurance paid.

However, the driver claimed additional, significantly higher costs: for legal fees, transport, excess, loss of use, expert costs, new rims and tires and depreciation of the car, he demanded around 25,000 euros from the workshop.

The district court of Munich II did not share this view.

In principle, the workshop must be liable for its work.

But: In this case, the customer bears a contributory negligence of 30 percent.

The reason given by the judges was that the driver should have retightened the wheel nuts himself after driving 50 kilometers.

The workshop pointed this out twice - in writing on the invoice and verbally when the vehicle was handed over.

Accident after changing winter tires: plaintiff only receives a fraction of his claim

Nevertheless, the workshop is also liable because the employees did not tighten the screw tight enough or did not check it sufficiently.

For this reason, the workshop operator is partly to blame for the accident - but not all of it.

At 1,650 euros, the plaintiff was only awarded a fraction of his original claim.
