The European Commission has informed Meta of its preliminary opinion that

the company has breached EU antitrust rules by distorting competition in the online advertising market

.

The Commission does not agree with the fact that Meta links its online classifieds service, Facebook Marketplace, to its personal social network, Facebook.

The Commission is also concerned that Meta is imposing unfair trading terms on Facebook Marketplace competitors for its own benefit.

If confirmed, these practices would violate Article 102 of the Treaty on the Functioning of the European Union ("TFEU") which prohibits the abuse of a dominant position.

The Commission takes the preliminary view that Meta is dominant in the market for personal social networks, which extends across Europe, and in the national markets for online advertising on social media.

The Commission preliminarily considers that Meta has abused its dominant position in the following two ways. First, Meta links its online classifieds service Facebook Marketplace to its dominant personal social network Facebook. This means Facebook users automatically have access to Facebook Marketplace, whether they want to or not The Commission is concerned that Facebook Marketplace's competitors may be foreclosed, as the constraint gives Facebook Marketplace a substantial distribution advantage that competitors cannot match ".

“Second, Meta unilaterally imposes unfair trading terms on competing online ad services advertising on Facebook or Instagram. The Commission is concerned that the terms and conditions, which allow Meta to use competitors' ad data for the benefit of Facebook Marketplace, are unjustified, disproportionate and unnecessary for the provision of online advertising services on Meta's platforms: these conditions impose a burden on competitors and only benefit Facebook Marketplace".

Article 102 of the TFEU prohibits the abuse of a dominant position.

The implementation of these provisions is defined in the antitrust regulation (Council Regulation 1/2003), which can also be applied by national competition authorities.

On 4 June 2021, the Commission opened formal proceedings on possible anti-competitive behavior by Facebook.
