Didn't receive an inflation compensation premium?

Employees must now take this into account

Due to the rising energy costs and food prices, employees now have a chance at the inflation compensation premium.

Who is entitled to it - and who is not?

And what can employees do if they have not received the bonus?

Food prices and energy costs have been exploding for months.

Consumers therefore have to dig deeper into their pockets - inflation is also noticeable in everyday life and experts even fear a wave of bankruptcies.

Because one thing remains the same for many: the salary.

As a reaction to the current situation, the federal government has therefore launched the so-called inflation compensation premium.

And it can even amount to up to 3000 euros - tax and social security free.

But who gets this bonus at all – and who doesn't?

And what can workers do if they don't get an inflation premium?

asked.

Inflation Compensation Premium: A voluntary benefit from the employer

The basis of the premium is the "Law on the temporary reduction of the sales tax rate on gas deliveries via the natural gas network," explains Volker Henn-Anschütz, a lawyer who works for the Gefeuert.de portal.

This regulates the one-time payment by employers to their employees.

But beware, the following generally applies: “However, there is no legal entitlement to this;

it is a

voluntary service.

The only requirement is full-time or part-time employment.” Good news for mini-jobbers, trainees, interns and working students – unlike the self-employed, they are therefore entitled to the bonus payment.

One-time payment, tranche or voucher: the inflation premium is so diverse

Employers are relatively free to decide how to pay out the bonus.

Whether as a collected one-time payment, in tranches, quarterly until the end of 2024 - or not at all.

There are even more possibilities.

"The premium can also be granted in the form of non-cash benefits such as goods or fuel vouchers," says the lawyer.

The bonus does not have to be expressly marked as an "inflation premium".

“The inflation compensation premium is a voluntary benefit to the employer’s dependent employees, which must be paid in addition to the wages that are already owed.

It doesn't have to be specifically named as such.

It is sufficient if it is made clear when the payment is made that the payment is related to the price increase, for example by a corresponding note in the payslip."

Inflation premium instead of Christmas bonus?

Employers cannot offset the payment

But does that now also mean that employers can equate the inflation compensation premium with the Christmas bonus?

In this respect, the employment law expert can deny: “The inflation compensation premium is not to be equated with the Christmas bonus.

As a result, a contractually agreed Christmas bonus cannot be substituted for or offset against this.”

But what if the employer waives the inflation premium entirely?

Or even cancel the annual Christmas bonus?

Unfortunately, the answer from the experts is less positive: Since there is no legal entitlement to the bonus and it is a voluntary benefit from the employer, employees have no legal recourse.

Didn't receive an inflation premium?

The principle of equality can help

But: “However, an entitlement can arise from a company agreement on the payment of an inflation compensation premium or a corresponding collective agreement regulation.

In addition, a claim can also result from the so-called principle of equality if an inflation compensation premium is paid, but not to all employees or in a different, objectively unjustified amount.

In some cases it also says: be patient.

The time of payment is decisive.” Employees still have the chance to receive the bonus until the end of the year after next.

And even with planned salary negotiations, inflation is not a very good argument.
