A new capital gains front of sports justice is reopening, and Juventus is at the center, but not only.
The Juventus club, already grappling with the investigation into the financial statements of the Turin Public Prosecutor's Office and with the UEFA investigation into financial fair play and the agreement reached, now risks having to face as many as three sporting trials in the FIGC: the file opened by Prosecutor of Giuseppe Chinè on the contracts affair, immediately after the resignation of the Board of Directors, the request was added today to reopen the capital gains process concluded on appeal with nothing done and the opening of a further file, on new relevant facts, i.e. capital gains with other clubs than those of the already closed sports process, which emerged from the new documents acquired by the Turin prosecutors.
A note in which Juventus explains that "it will be able to articulate its defenses in the terms established by the code, trusting that it will be able to further demonstrate the correctness of its actions, the absence of new elements that have arisen that are relevant for the judgment with respect to the decision of the Federal Court of Appeal and the lack of the conditions of the proposed appeal".
Close to a certainly not festive Christmas, the FIGC prosecutor has therefore put the Juventus club back in its sights, together with other companies.
The investigation by the team led by Chinè, which had not stood up to the double judgment of the Federal Court and the Court of Appeal - with the acquittal of about sixty managers and eleven companies, five of which in Serie A - found new life in the deeds arrived from Turin,
requested and acquired immediately after the request for indictment by Andrea Agnelli, Pavel Nedved and other Juventus managers.
Those acts were examined by the FIGC prosecutor's office and today led to the notification to the interested parties of the request for revocation of the definitive sentence of the sports justice, as well as the opening of a new investigation.
The clubs involved, in addition to Juve, are Samporia, Pro Vercelli, Genoa, Parma, Pisa, Empoli, Novara and Pescara.
The appeal also concerns 52 executives of the same companies and will lead to a request for a sentence to be paid during the hearing to discuss the appeal before the Federal Court of Appeal.
But the Public Prosecutor's Office, following the acquisition of the documents from Turin, has launched, as part of a new proceeding, an investigation activity within its competence against Juve and other clubs "for further disciplinary conduct".
In the proceeding concluded in May, the Prosecutor had requested to sanction the companies involved with maxi fines, without penalties in the standings - even if provided for by the CDS -, and to inflict long inhibitions on the managers.
For the then Juventus president, Andrea Agnelli,
they had been asked for a year of inhibition (and a 800 thousand euro fine for the club) and 16 months for the former sports director, Fabio Paratici but both - in addition to all the other 'accused' - had obtained the acquittal in the first instance and the rejection of the appeal.
Following the notice of guarantee to Agnelli and other Juventus managers, Chinè had asked the Turin prosecutor's office to acquire new documents of the investigation to assess whether there were elements to reopen the trial.
Which happened, in accordance with article 63 of the cgs, involving companies cited in the criminal investigation as being affected by the capital gains domino, among which there is no Napoli.
In the meantime, the prosecutor led by Chine', after the resignation of the Juventus board of directors, had opened another file on the chapter on Juventus contracts,
The news of the possible revocation arrived on the day in which the new general manager Maurizio Scanavino introduced himself to the team and staff.
"He said a few but significant words. The programs do not change and there is the same ambition to win", said the Juventus coach, Massimiliano Allegri, after the success in the friendly against Rijeka at the Stadium behind closed doors.
The club is therefore trying to restart and move on after the jolt of almost a month ago, with the resignation of the entire board of directors last November 28, but the road is now even more uphill, with the reopening of a investigation of the sports justice that was hoped to be closed.
