Too small, broken, don't like it - This applies to the exchange of gifts

Christmas is over.

Many were richly rewarded.

But not every gift triggered tears of joy.

Some things don't meet the taste at all or don't fit.

Then it's time for an exchange.

Both customers and dealers have rights.

Munich – The sweater doesn't fit, the cookbook is already in the household.

Many gifts - no matter how well intentioned they are - are not well received by the recipient.

What rights do consumers have in the case of returns and exchanges?

Exchange gifts only with agreement?

"If the gift is absolutely not to your liking or if it was under the Christmas tree twice, you do not automatically have the right to exchange it," informs the consumer advice center.

If the goods were bought in a shop, the customers are dependent on the goodwill of the retailers.

If no written assurance was given at the time of purchase that the gift can be exchanged, the relevant shop does not have to take it back because it is not to your liking.

Somewhat different rules apply to modern mail-order business.

This applies to the exchange of gifts, from the Internet

If someone bought a gift online or ordered it over the phone, returning it is easier.

Because almost every contract concluded on the Internet can be revoked within 14 days.

Canceling the purchase and returning the goods is also possible if you do not like the goods.

Because unlike in the local shop, customers cannot check the goods before buying.

To compensate for this, you have the right to cancel a contract of sale via mail order without any reason.

To do this, the customer writes to the retailer within two weeks of receiving the goods that they are revoking the purchase contract.

The goods will be returned.

In return, the payment goes back to the customer.

In Germany, every fourth package goes back - to the benefit of consumers and at the expense of the climate.

Those who mean well and have Christmas presents delivered too early - around November - can be unlucky.

Then after Christmas Eve there is no time to cancel the deal.

The last chance to get rid of an unwanted gift can be exchange markets or second-hand shops.

Exchange gift because broken or damaged

The new iPhone has a quirk, the PlayStation doesn't work or the zipper on the ski jacket is broken.

In such cases, the recipients have clear rights.

In the case of new purchases, there is a two-year period in which to assert claims at retailers.

It doesn't matter whether the goods come from the Internet or a retail store.

Exchanging gifts, trade has rights too

The consumer advice center informs retailers that they can insist on having defective products repaired or exchanged for an equivalent product that is free of defects.

If that doesn't work, customers could reduce the purchase price or insist on a refund.

If a dispute arises because of a defect, retailers must prove within twelve months of purchase that the goods were faultless when purchased.

Exchange a gift and get cash for it?

"Exchange means exchange because something is exchanged," writes

tagesschau.de

.

That means: goods against goods.

Not goods for money.

Most traders want to keep their profit margin from the original deal.

Therefore, they usually exchange for other goods or offer vouchers for a later purchase.
