A new year is almost synonymous with changes.

In 2023, they will also affect tenants, landlords and property owners.

There are a few things you need to pay special attention to from January.

New from January: the Building Energy Act

The efficiency house 55 (EH 55) applies from January 1st as the legal new building standard.

The permissible annual primary energy requirement is also reduced to 55 percent (EH 55).

Previously, 75 percent (EH 75) was included as a reference for water heating, heating, cooling and ventilation.

Housing benefit reform from January

Punctually at the beginning of the year, what the federal government says is the “biggest housing benefit reform in the history of Germany”.

Reducing carbon dioxide and renovating with more energy: the climate tax

So far, the CO2 taxes have been the main burden for many tenants.

That will change from January 1st. Then the landlords will also be held accountable for the costs.

Properly formulated, official German will in future refer to the Carbon Dioxide Cost Allocation Act.

The law passed in November 2022 is intended to help reduce carbon dioxide emissions and create incentives to save energy overall and make buildings more energy-efficient.

Rent index from 2023

If a place has more than 50,000 inhabitants, a rent index must be drawn up.

Simple rent indexes should be available from the New Year, for qualified rent indexes you have until January 2024.

By the way: If landlords add an inflation surcharge to the amounts despite the rent index, this is usually not legal.

Decided for one year: gas and electricity price brake

From March 2023 to April of the following year, the gas price is to be limited to twelve cents per kilowatt hour (gross) – at least for private households.

And that for 80 percent of the annual consumption of the previous year.

The relief amounts for January and February 2023 will be credited retrospectively in March.

This gas price brake for gas and heat applies equally to tenants and landlords for around 13 months.

The electricity price brake should also be effective for the same period.

Including all levies, taxes, network charges and surcharges, the gross electricity price for private consumers will be 40 cents per kilowatt hour.

The same applies to small and medium-sized companies that consume up to 30,000 kilowatt hours of electricity a year.

The electricity price brake applies to the basic requirement of 80 percent (compared to the previous year's consumption).

As with the gas price brake, January and February are counted retrospectively.

Annual tax law: Improvement in the home office flat rate

With the annual tax law, the federal government wants to introduce tax improvements.

In doing so, she also takes up projects in the coalition agreement that are intended to relieve the tax burden on citizens.

According to the federal government, these include:

  • Home office flat rate

    - continuation and improvement: Taxpayers can claim six euros for each calendar day on which they work from home.

    From 2023 this will be a maximum of 1,260 euros (previously 600 euros).

    This will take into account 210 home office days in the future (previously: 120 days with five euros each).

    This regulation also applies without an extra study.

  • Photovoltaic small systems

    : Here there is a tax improvement when purchasing: exemption from income tax and value added tax.

  • New residential construction

    - improvement in depreciation: depreciation rate for completions from July 1, 2023 will be increased from two to three percent.

    According to the federal government, "the possibility of special depreciation in the construction of new rental apartments will be reactivated and aligned to special efficiency criteria".

  • Inheritance and gift tax

    : be careful, the valuation bases have been adjusted here and higher taxes may be due from January 2023.
