In his satirical show »ZDF Magazin Royale« moderator Jan Böhmermann declared the FDP to be the new RAF last year.
He also showed a fictitious wanted poster, which he tweeted in advance and showed journalists in addition to FDP politicians.
An alleged photo of the "Welt" editor Stefan Aust could also be seen on it.
Now Aust has obtained an injunction against the broadcast of November 25, 2022, Böhmermann initially tweeted.
A spokesman for the Hamburg Higher Regional Court confirmed to SPIEGEL that Aust had filed an application for an injunction with the Hamburg Regional Court.
But it's not about the show as a whole, but about a photo on a kind of collage that will be shown in the show on November 25th.
"Both in the advance notice of the program and in the program itself, a photo collage was shown in the style of a manhunt call from the seventies - headed 'Left-wing violent criminals - Lindner/Lehfeldt gang'." "The problem with the whole thing is that the photograph doesn't show Stefan Aust, but the actor Volker Bruch, who played Stefan Aust in the film 'The Baader Meinhof Complex'." The film is based on the non-fiction book of almost the same name by the former SPIEGEL editor-in-chief Aust .
According to the district court, the viewer could not understand this otherwise than that the person depicted was Stefan Aust.
But she is not.
So this is a breach of privacy.
The district court agreed with Aust.
The distribution of the alleged Aust photo is therefore prohibited from today.
ZDF must now decide how to proceed.
In any case, the photo may no longer be shown with this caption.
The broadcaster could hide the image in the program, for example, or remove the episode entirely from the media library.
Böhmermann's action led to mixed reactions at the time, for example on Twitter.
While some users wrote, for example, that Böhmermann held up a mirror to certain media and politicians and "pressed the right button", others tweeted that it was "insidious".
