Police made allegations that the doctor from Hadassah Ein Kerem provided food to the terrorist, congratulated him and called him Shahid • As a result, the hospital suspended him from his job • The draft compromise agreement obtained by "Israel Hayom" further reveals that Hadassah will return to work and will consider his time of absence as part of the internship period

The management of the Hadassah Ein Kerem Hospital in Jerusalem retracts the allegations against Dr. Ahmed Mahajana, a specialist doctor in the department of cardiothoracic surgery in Hadassah Ein Kerem, who was suspected of giving the terrorist a sedative, and he is about to return to regular and full work in the department. As part of the extraordinary mediation that has been going on for the past few weeks between the doctor, the Hadassah management and the Medical Association, which was obtained by Israel Hayom. However, the mediation agreement has not yet been signed, and it is not official and is not yet final.

The complaints against Dr. Mahajana, as revealed in Israel Hayom, were filed by two police officers who on October 26 watched over a terrorist in the department who carried out a stabbing attack in Jerusalem and was wounded by security forces. The police officers complained that the doctor served the patient refreshments and foods that were not foods of the hospital, and that he congratulated him and called the detainee "martyr" in front of female employees in the department. Also, the police officers claimed that he refused to identify himself to them and even insulted one of them.

Following the complaints, on November 20, Dr. Yanon Buda, MD, director of Hadassah Ein Kerem Hospital, held a hearing for the doctor, at the end of which he leveled a very sharp criticism against him for "the most serious incident, for serious disciplinary violations that have the potential for a flare-up and serious injury In the public order; actions that severely damage the status and reputation of Hadassah, and they justify taking severe disciplinary measures and terminating his employment at the hospital."

Following the complaint and the hearing, the specialist doctor was suspended from his job.

Going to mediation

After a strong protest by the Medical Association, which claimed that there was no legal justification for terminating the intern's work, and severe public and media criticism directed at Hadassah's management, a process of mediation between the parties began before retired judge Hila Gerstel.

At the beginning of the mediation, the hospital's management announced that "this is an unusual incident in which cakes were put into a detainee suspected of carrying out an incident of hostile sabotage activity, and who is under police supervision. A confrontation with the police officers developed at the scene. Such an incident requires a thorough investigation and the management intends to have a professional, matter-of-fact procedure as fast as possible." .

"Israel Hayom" has learned that the mediation agreement that is taking shape these days shows that Hadassah actually retracts most of the allegations against the doctor.

An agreement is formed between the parties that on the day of the incident, an event was held in honor of the success in the exam of Dr. Mahajana and another doctor in stage 1 of the internship. After that, refreshments left over from the event were distributed in the department to the patients. Agreeing that the statements attributed to Dr. Mahajana in connection with the terrorist were not made.

Furthermore, from the agreements formed between the parties in the mediation agreement, it appears that Hadassah states, according to the opinion of senior doctors, that Dr. Mahajana is considered a professional doctor, with good human relations who is always ready to help and is devoted to his patients.

Dr. Mahajana clarifies in the agreement that as a person and a doctor he sees human life as the highest value and opposes any violent activity or harm to any person whatsoever, including acts of terrorism, and that in this spirit and according to the rules of medical ethics he acts and will act. The agreement that is being formed also states that the management Hadassah acted in good faith in this case, in view of the nature of the allegations made in this incident because it had to conduct a thorough investigation, and that there were no extraneous motives behind the investigation conducted by the hospital's management.

One of the main issues that have remained in dispute as part of the mediation is Hadassah's demand that, as part of the mediation agreement, Dr. Mahajana apologize to anyone who was harmed by his behavior towards the policeman who asked him to identify himself and then photographed him. There is still no agreement between the parties on this issue, and this The main reason that the agreement is delayed and has not been signed yet.

Hadassah towards the doctor

The mediation agreement that is taking shape indicates that the doctor will immediately return to his work at the hospital and will continue to provide dedicated care to all patients.

The hospital will take into account the need to fill in the gaps created during the internship period, and it will even help ensure that the time of his absence is considered part of his internship period in the department.

It also appears from the emerging agreement that the parties are very sorry for the incident and the turn of events.

The mediation agreement that is taking shape indicates that the doctor will immediately return to his work at the hospital and will continue to provide dedicated care to all patients,

As part of the emerging agreement, the parties undertake not to publicly disclose or refer in any way to the agreement.

It also appears that the parties declare that the mediation agreement was drawn up out of an understanding and agreement that Hadassah has enshrined in its banner existence with respect for all populations and treating everyone with respect - both the staff and the patients.

Mahdassa responded: "The mediation process is still ongoing and there are no agreements. We recommend to the parties with whom we are discussing, that they invest their time in mediation and reaching agreements, instead of trying to manipulate through the media."

Attorney Ofer Doron who represents the doctor said on his behalf that they are prevented from commenting on the mediation.
