He decided to revoke the defense mandate of his now ex-lawyers and entrusted himself to a new defender Alessia Pifferi, the 37-year-old in prison since the end of last July on charges of aggravated voluntary homicide for having left her daughter Diana to starve for almost a year and a half, leaving her alone at home for six days.
It emerged this morning from the hearing before the investigating judge of Milan Fabrizio Filice, which was set to discuss the results of the expert report, which had already emerged in recent days, which ruled out the presence of tranquilizers in the bottle and bottle of water found near the body of the little girl.
The woman revoked the mandate of the lawyers Solange Marchignoli and Luca D'Auria and relied on the lawyer Fausto Teti (it seems she still retains the defense consultant Luciano Garofano, former general of the Ris) who asked for terms of defense to better prepare the hearing and the judge postponed it to February 8th.
While the prosecutors Francesco De Tommasi and Rosaria Stagnaro in the next few days will forward the request for an immediate trial to the magistrate's office and Pifferi will end up in trial before the Milan Assizes Court (he risks a life sentence).
Only five days ago the lawyers Marchignoli and D'Auria had commented on the results of the expert report, requested by the defenders and ordered by the investigating judge, explaining that "Alessia has always been genuine in her story and, on a legal level" the "premeditation lacks concrete elements , given that it would have been the poisoning of little Diana".
Surprisingly today in the hearing it was learned that the woman had revoked the mandate, so much so that the lawyer Teti appeared before the judge (Pifferi did not appear at the hearing).
Pifferi had always repeated in the record that he had never administered benzodiazepines to her daughter.
Instead, it was hypothesized by the investigators, also because none of her neighbors had ever heard her cry in those days and some traces of tranquilizers were later found,
in medical examinations on the child.
Initially the Public Prosecutor's Office had also challenged premeditation among the aggravating circumstances, but then the investigating judge had excluded it in the ordinance.
The judge had instead confirmed the aggravating circumstance of having acted for abject and futile reasons, disputed together with that of having killed her daughter.
The charge of the request for immediate trial (the preliminary hearing is skipped) should be based on what was established by the investigating judge in the precautionary order.
In the late morning, the lawyer Franco Fausto Teti, the new lawyer of Alessia Pifferi, the 37-year-old in prison since last July on charges of killing her daughter Diana, leaving her alone at home for six days, will meet the woman in the Milan prison of San Victor.
The defender himself explained it, clarifying that he has not yet spoken to her face to face and that he will remain in conversation with the 37-year-old today to get to know her and set up her defensive line.
Meanwhile, the lawyer has asked the investigating judge for terms of defense and the hearing on the evidentiary incident, set for today, has been adjourned to 8 February.
