Judge Ana Pérez Ballester, head of the Family and Minor Court No. 1 of La Pampa, was denounced for
breach of the duties of a public official
in the context of the murder of Lucio Dupuy, since the magistrate had been the one who granted the possession to the mother, now in the dock with her girlfriend for the heinous crime of the child.

, the child's parent, and her partner Abigaíl Páez, will receive the verdict in the case that investigated Lucio's murder on Thursday, February 2.
However, the boy's grandfather, Ramón Dupuy, also pointed out Judge Ballester who allowed Lucio to stay with his aggressors despite the
innumerable claims of the victim's father
, and having been admitted
to the emergency room at least five times with various injuries
resulting from abuse.
The women were accused of “seriously insulting sexual abuse due to the circumstances of its realization with anal carnal access with an object, aggravated by having been committed by the ascendant;
with the help of two people and taking advantage of living with the victim under 18 years of age;
everything as a continued crime;
in a real contest with homicide qualified for being the ascendant, for
cruelty and treachery
”.
The criminal complaint against the judge was filed by the
Mas Vida Foundation – a pro-life NGO and defender of Human Rights
in the Primary Care Unit, under the Public Prosecutor's Office of the Province of La Pampa.

They seek to determine the guilt of the magistrate, together with the other dependent officials who have acted from the court in the process, according to the complaint,
without taking the socio-environmental precautions of the case, they delivered Lucio to the home where he would finally find death.
Raúl Magnasco, president of the complainant foundation, highlighted the responsibility that in his opinion falls on the judge:
"We are facing an obvious case of poor performance."
"When custody was handed over to Lucio's uncles,
they subjected them to all possible environmental studies
, but when it came to handing him over to the couple responsible for his torture and death,
the judge failed to comply with the controls
," Magnasco analyzed.
For the head of the NGO, the judge's decision
"led to Lucio's preventable death.
" "We trust that the prosecution will assume its role and that Judge Ballester will at least step aside."
Judge Ana Pérez Ballester, in the crosshairs for granting possession of Lucio Dupuy to his mother and her partner.
"Lucio lost his life in the worst way, but who knows
how many more children are in danger
at this very moment due to the actions of this judge," he concluded.

Before the sentence, Lucio Dupuy's grandfather asked for "an exemplary sentence" against the defendants and "that they be separated once and for all."
