Lucio Dupuy's mother and her partner
were found guilty
this noon in the Pampas city of Santa Rosa by a court that considered they murdered the 5-year-old boy in November 2021, for which they will receive a life sentence.
The sentence was handed down after 12 o'clock by the Court of Hearings of La Pampa, which considered that the mother of the child,
Magdalena Espósito Valenti, was the material author
of the "triplely qualified homicide due to cruelty, treachery and the link" but was acquitted by sexual abuse.
While his partner Abigail Páez was the material author of the "homicide qualified by cruelty and treachery and by
seriously outrageous
sexual abuse" of the child.

What the verdict says:
In merit of the foregoing agreement, the Trial Court of the city of Santa Rosa, RESOLVES: First:
Reject the proposals of defective procedural activity made by the defendants' technical defenses.
Second:
Declare Magdalena Espósito Valenti, of personal conditions present in the present, material author and
criminally responsible for the crime of homicide triple qualified by the link, treachery and cruelty (articles 80.1 and 80.2 of the CP), to the detriment of Lucio Dupuy.
Third:
Declare Abigail Páez, of personal conditions present in the present,
material author and criminally responsible for the crime of homicide doubly qualified for treachery and cruelty, in real competition with the crime of sexual abuse with carnal access by anal route, executed with a phallic object, aggravated for being the guardian and for having been committed against a minor under 18 years of age, taking advantage of the pre-existing situation of coexistence, as a continuing crime (articles 80.2, 55, 119 first and third paragraph and subsections b) and f) of the fourth paragraph and 55 -a contrario sensu-, both of the CP), to the detriment of Lucio Dupuy.
Fourth: Absolve Magdalena Espósito Valenti, of personal circumstances already indicated, for the fact of aggravated sexual abuse for which she was duly accused, by application of article 6 of the CPP
Fifth: Considering the resolution in the second and third points of this resolution and in order to carry out the sentence imposition hearing, set a hearing for February 13 of the current year at 8 am.
The parties are notified so that within a period of five days - from the reading of this letter - they offer the relevant evidence or indicate that which they will use (art. 343 second paragraph of the CPP).
