Lucio Law: what is the project that seeks to prevent violence and abuse in childhood and what is it about

Deputies gave half a sanction to the 'Lucio Law' so that teachers and doctors can report cases of child abuse. The verdict of the trial will be announced today.


A year ago, the

Federal Training Plan on the rights of minors

, aimed at people who work in areas and dependencies of the Executive, Legislative and Judicial Branches of the National State.

The provinces, municipalities and social, sports and recreational organizations may also join. 

"The Family, Childhood and Youth Commission and the Budget and Treasury Commission voted unanimously in favor of the proposal. We hope that the campus will give it half a sanction, since it is accompanied by all the blocks. There are no bankruptcies in this," he said before the vote

In turn, there were two initiatives presented by the radical deputy Roxana Reyes and her counterpart from the Frente de Todos, Paola Vessvessian.

The three proposals were taken into account at the time of the favorable opinion of the Family commission.


"The week after the crime, I visited Lucio's family. They told me that we had to do something

so that this atrocity would not happen again

, although nothing was going to change that Lucio was not going to return," recalls Maquieyra.

And she clarifies: "All this time we worked with them."

Three key points of the "Lucio Law" project

The deputy maintains that the law has three key points.

On the one hand, training State employees who work in relation to children "to realize if a child is a victim of abuse."

In fact, Lucio's father, Cristian Dupuy, requested his custody because the baby suffered from physical and psychological violence, but the Justice ignored his request and determined that he continue to live with the mother.

The second issue is that members of educational and health establishments, public or private, and any public agent or official may

anonymously report violations of children's rights

Law 26,061 obliges health and education personnel to report, but for fear of possible reprisals, they often do not do so.

"In fact, at Lucio's school a teacher denounced the family of a student and the boy's mother went to school the next day and beat her," says Maquieyra.

Therefore, the care of anonymity is provided for in the proposal. 

The deputy said that reporting the mistreatment Lucio received was

the responsibility of the doctors and teachers who did not do so

.

"The boy entered the guard five times in three months for presenting injuries, some of them serious, before they killed him," he clarifies. 

The third tool provided by this bill is to carry out biannual awareness campaigns on violence and violation of the rights of children and adolescents.

Lucio's family will send a letter to President Alberto Fernández so that the Senate can deal with the project in extraordinary sessions. 

"He gave me his condolences and I told him to expedite the Law

," explained Ramón Dupuy, the boy's grandfather, about the meeting he had with the president last May. 

The training modality may be online or face-to-face.

The number of hours and other issues will be defined by the Federal Council for Children, Adolescents and Family (Cofenaf) and the National Secretary for Children, Adolescents and Family, dependent on the Ministry of Social Development of the Nation.

In addition, the proposal of the Pro deputy states that the implementation of line 102 that provides specialized assistance on the rights of children is mandatory throughout the country.

"Precisely in La Pampa, where Lucio was murdered, it only started working in August of this year," says Maquieyra.

And he clarifies: "That was the last province that needed to join."

In parallel to the half sanction of the "Lucio Law", this Thursday begins the trial against the mother of the minor

The pending sentences are life imprisonment.

Lucio's mother will be tried under the charges of "homicide triple qualified by the link (because it is ascendant) and with cruelty and treachery; in real contest with seriously outrageous sexual abuse due to its duration and concrete forms of realization, triple aggravated for being the guardian at the time of the facts, for being committed by two people and for living with the victim under 18 years of age, as a continuing crime".

In the case of Páez, the only difference in the accusation is that the homicide is "doubly aggravated", since she is not charged with the link.

The Santa Rosa courts are already fenced off, since the defendants will be in the courtroom.

The two are imprisoned in Penitentiary Unit No. 1 of the capital San Luis.

"Life imprisonment would give us some relief, but I'll be at peace when there are no more Lucios," said Ramón Dupuy, Lucio's paternal grandfather.

More than 100 witnesses

are expected to testify

and the debate to end on December 22.

While the verdict would be known in February 2023.
