The Chamber confirms its confidence in the government on the NGO decree law with 202 votes in favour, 136 against and four abstentions.

The decree, which will be approved tomorrow and must pass the Senate, intends to regulate the action of NGO ships in the Mediterranean, with the dual objective, on the one hand, of ensuring the safety of people recovered at sea and, on the other, the need to protect public order and safety.

It introduces new rules for the rescue of migrants at sea operated by the ships of non-governmental organizations by modifying some paragraphs of the so-called Lamorgese decree and regulating the issue of multiple rescues.


    The transit and parking of ships in the territorial sea are in any case guaranteed for the sole purpose of ensuring the rescue and assistance on land of the people taken on board to protect their safety.

Vessels carrying out search and rescue activities at sea must: possess the authorizations issued by the competent authorities of the flag State and the technical-nautical suitability requirements for safe navigation in territorial waters;

having promptly collected, subject to information, the intentions of migrants to request international protection;

request, immediately after the event, the assignment of the port of unloading;

reach the port of unloading indicated by the authorities without delay, to complete the rescue;


    If the NGOs violate these provisions, an administrative fine ranging from 10,000 to 50,000 euros is applied to the master of the ship.

Joint and several liability extends to the shipowner and the owner of the vessel.

The Prefect of the province affected by the landing is responsible for the imposition of the sanctions ascertained by the control bodies.

The administrative detention for two months of the vessel used to commit the violation is then applied.

In case of recurrence of the violation with the same ship, the ancillary administrative sanction of confiscation of the ship is applied and the investigating body immediately proceeds with precautionary seizure.


    Penalties ranging from 2,000 to 10,000 euros are also envisaged for the ship's master and owner who "fail to provide the information requested by the competent national authority for search and rescue at sea or do not comply with the indications of the same authority" .
