Spain, 'trans law' and menstrual leave at the start

From the age of 16 it will be possible to request the change of one's gender at the registry office. The law does not contemplate issues concerning hormonal processes, which are instead dealt with in regional laws (ANSA)


   Final go-ahead from the Spanish Parliament to the so-called "trans law" and a reform of the law on abortion.

The final "yes" came in both cases after a final passage in the Congress of Deputies.

The 'trans' law contemplates the right to free "gender self-determination" for all over 16s. The abortion reform includes a leave for "disabling" menstruation covered by the state.

The new law provides for the possibility of requesting the change of one's gender in the registry office (through a double declaration after three months) without judicial or medical authorizations starting from the age of 16 (from 14 with parental consent)

   The so-called Spanish "trans law", a law that establishes new rights for transgender people such as "self-determination" has faced its last step in Parliament with the final vote on the text, after the preliminary "yes" already expressed between December and last week by the House itself and the Senate.

The law was promoted in particular by the Minister of Equal Opportunities Irene Montero (Unidas Podemos) and requested by LGTB+ collectives.

The law and the consequent controversies have caused deep divisions within the vast and influential Spanish feminist movement: in particular, a part of feminists says they are against this law as they see in it potential problems of "juridical insecurity",

   The law does not contemplate questions concerning hormonal processes, which are instead dealt with in regional laws, explains La Vanguardia.

In today's session, Congress was also called upon to vote definitively on a reform of the law on abortion aimed at promoting access to it.

The law also provides for menstrual leave paid from the first day by the state for women with "disabling" cycles
