In 2021 the disciplinary section of the CSM had sentenced the then Florence prosecutor Giuseppe Creazzo to the loss of 2 months of seniority for sexually harassing his colleague Alessia Sinatra.
Today it was she who was sentenced by the same "court", to the sanction of censorship, for having behaved "gravely incorrect" towards Creazzo, for some text messages sent to Luca Palamara.
An unexpected sentence given that the general prosecutor of the Cassation had asked for acquittal.
Sinatra's lawyer speaks of a "serious setback in the defense of victims of abuse in the workplace".
The accusation against Sinatra referred precisely to the messages sent to the former president of the ANM Palamara, leader of Unicost at the time, ("swear to me that the pig will fall immediately", "my group must not vote for it") when Creazzo ran for the appointment as prosecutor of Rome that the CSM should have decided shortly.
According to the contestation for which she was convicted, the prosecutor thus wanted to try to negatively influence the councilors for a sort of "moral revenge" on the head of the prosecutors in Florence.
The reaction of Sinatra's lawyer, Mario Serio, was harsh: "The sentence of the disciplinary section condemning a magistrate, already the victim of ascertained sexual abuse by a colleague, who was only to blame for having in a private conversation - destined to not be divulged and in spite of this, his indignation at the possible promotion of the perpetrator of the act and, in an equally private sphere, the lack of recognition of professional success, is made manifest, marks a serious setback in the defense of the victims of abuse in the field work and raises serious alarm".
"Despite the justified request for acquittal due to the lack of relevance of the fact formulated by the Attorney General of the Cassation - continues the lawyer - the disciplinary section of the CSM, composed equally of male and female components and with a replacement for reasons not disclosed, sentenced the woman magistrate to the disciplinary sanction of censorship, evidently neglecting each of the defensive arguments and even the heartfelt, touching self-defense of the accused who explained the psychological background and the purpose of the messages, which represented nothing but a secret outlet of a woman violated.It is a dangerous precedent both on the jurisprudential level and on the level of social custom which cannot fail to strike the chords of widespread female sensibility.Naturally - concludes Serio - the hope is that the Cassation, which is finally about to find a very prestigious and courageous female presence at its top, will pronounce the appropriate and definitive word of Justice and equity".
