Council of State, extension of bathing establishments should not be applied

No automatic renewal of state-owned maritime concessions. The League: 'We demand the norm, speed up the mapping'. Bonelli: 'It is a defeat for the Meloni government' (ANSA)


The rules that have ordered the automatic extension of beach concessions "are in contrast" with article 12 of the European directive and, therefore, "must not be applied".

This was reaffirmed by the Council of State in the sentence in which it accepted the appeal against the decision of the municipality of Manduria to extend the state-owned maritime concessions until 2033.



"The sentence of the Council of State does not surprise us. The judges already announced in 2021 that any extension following the beach concessions would be considered by them ineffective. However, we claim the rule introduced with the conversion into law of the 'Milleproroghe' and the right of Parliament to legislate. All the more reason after this pronouncement, we invite the government to speed up the mapping of the coasts".

This was stated by the vice president of the Senate Gian Marco Centinaio (Lega), commenting on the news of the new sentence of the Council of State on beach concessions.



"The decision of the Council of State warns the Italian government, recalling that it should not play with European directives and the Constitution. European directives cannot be disregarded or not applied and extensions cannot be authorized by individual local administrations. This is a tough defeat of the Meloni government which fought in defense of the privileges of those who pay the state, such as for example in the case of Twiga, only 20,000 euros against a turnover of around 4 million euros a year".

Thus in a note Angelo Bonelli co-spokesman of Green Europe and deputy of Greens and the Left "Let's remember - he continues - that the State collects only 107 million euros a year from the seaside concessions, while the total turnover is 7 billion euros, with a very high evasion rate.

Over the years, too many Italian beaches have been transformed from 'lungomari' into 'lungomuri', which close off the possibility of being able to see the sea, due to privatization and overbuilding: among all, one of the most emblematic cases is that of Ostia.

The Right has been trying to disapply the Bolkestein directive since 2010, but today's decision is a victory for an Italy that must not be founded on the usual privileged ones".
