(ANSA) - ROME, APRIL 21 - The Antitrust requires Meta to resume negotiations with Siae "maintaining a behavior inspired by the canons of good faith and correctness" .
This can be read in a note from the Authority which underlines that with the prior authorization of Siae, Meta will have to restore the availability of musical content on Facebook and Instagram.
The Authority adopts precautionary measures for an alleged abuse of economic dependence by Mark Zuckerberg's group, which will also have to provide all the necessary information in the context of the resumption of negotiations.
After the presentation of the written briefs and the hearing of the parties, the Authority considered that the conditions exist for adopting the precautionary measures.
In particular, the Antitrust - continues the note - "
identified the economic dependence of Siae from Meta on the basis of the presumption envisaged, for digital platforms, by article 9 of law no.
192 of 1998, emphasizing how in this case the evaluation criteria must be different from those usually used for other traditional economic sectors.
In this context, Meta's behavior appears to be abusive in nature and such as to cause serious and irreparable damage to the competitive dynamics in the markets relating to the management of copyright, affecting all the subjects that make up the supply chain (authors, subjects who contribute to the creation of the work and protected by copyright law, collecting societies that protect these rights, end users)". Therefore, the Authority - "
has ordered that Meta resume negotiations immediately, maintaining a behavior inspired by the canons of good faith and correctness and provide all the necessary information to allow Siae to restore balance in the commercial relationship with Meta.
Furthermore, subject to the authorization of Siae, Meta will have to restore the availability of musical content on Facebook and Instagram". Finally, the Authority established that, in the event of disagreement between the parties regarding the quantity and quality of the information to be provided by Meta will appoint a trustee who will identify them.
