The Minister of Public Accounts Gabriel Attal confirmed this Friday the tightening of the conditions of residence in France to receive social benefits, "from 2024", to fight against fraud.

The Minister of Public Accounts Gabriel Attal confirmed this Friday, April 21 that this change would take place "

from 2024

", in an interview with Europe 1, where he also announced the end of the payment of aid to accounts outside the European Union from 1st of July.

He would like to impose at least nine months of residence per year in France on people wishing to benefit from a social benefit.

For the moment, the residence condition differs from one aid to another.

For the less restrictive, it suffices to be present in France at least six months a year, on the same principle as tax residence.

These are family allowances, the minimum old age pension, widowhood insurance and the supplementary invalidity allowance.

The APL are paid for accommodation in France occupied at least eight months a year, "

except professional obligation, health reason or case of force majeure

", specifies the law.

Strengthen controls

Gabriel Attal would therefore like to align the residence condition for these social benefits to the most restrictive, that of the RSA, which requires nine months of annual presence in the territory.

However, this aid is still paid if this criterion is not met, but only for the “

full

” months of presence in France.

At the beginning of March, the minister had already mentioned this project to tighten the rules.

The government then supported an amendment by Senator LR Bruno Retailleau during the pension reform, which proposed this threshold of nine months for the minimum old age.

At the time, Gabriel Attal said he wanted to give access to the PNR file, which includes the data of air travelers, to the social security funds to help them better control this residence condition.

These announcements come a few days after the very commented remarks of the Minister of the Economy Bruno Le Maire, who mentioned sums defrauded and sent “

to the Maghreb or elsewhere

”.

Gabriel Attal acknowledged that social security contribution fraud remains difficult to quantify precisely, although it is "

estimated at eight billion euros per year

", without being able to specify the extent of the fraud on the residence condition.

Its hardening should be ratified at the beginning of May during the announcement of a global plan to fight against social and tax fraud promised by Emmanuel Macron during his speech on Monday April 17.
