Cocaine dealing, Cassation condemns the Bianchi brothers

The brothers Marco and Gabriele Bianchi, sentenced to life imprisonment in the first degree for the fatal beating of twenty-year-old Willy Monteiro Duarte in Colleferro (Rome) in September 2020, had "a widespread activity of drug dealing", in particular cocaine, whose supply to buyers was based on a coded language that defined the quantities in terms of "small t-shirts, big and sweatshirts". This is underlined by the Supreme Court which confirmed against the two brothers, experts in martial arts, the sentence of four years and six months each for drug dealing and attempted extortion. To nail the Whites - for whom the appeal assize trial for the murder of Willy is underway - were above all the interceptions, since their clients, questioned by the police, made "clearly reticent and fearful statements", notes sentence 24226 filed today by the Third Criminal Section of the 'ermines' and relating to the hearing that took place last March 14. In the opinion of the Supreme Court, with "adequate motivation without defects of logic", the Court of Appeal of Rome in its verdict of the eleventh of April 2022 - against which the defense college of the Whites appealed to the Supreme Court - confirmed the responsibility of the two defendants for drug dealing and attempted extortion reducing, for the lack of some episodes in competition, to four years and six months the original sentence, established by the Court of Velletri, to five years and four months. According to the supreme judges, the "slight extent of the facts" was correctly excluded - supported instead by the lawyers Vanina Zaru, Valerio Spigarelli and Ippolita Naso - as it was a matter of cocaine sales "repeated over time and without a substantial solution of continuity that demonstrated a not occasional but professional activity of drug dealing and, therefore, the possession of considerable quantities to be introduced, albeit from time to time and in modest quantities, on the market". So the appeal of the defense was declared "inadmissible", and the Bianchi brothers - detained immediately after the murder, serving their sentences in different prisons - were sentenced to pay three thousand euros to the Cassa delle ammende for the lack of solid reasons to appeal to the Supreme Court.
