The municipality of Hadera is asking the Supreme Court to order the postponement of the discussion on the huge plan promoted by the Ministry of Finance through the Otml in the east of the city, and planned for January 31, until after the elections to the local authorities, which are expected to be held on February 27, 2024.

The plan is an incarnation of a plan that has been promoted by the National Committee for the Planning and Construction of Preferred Complexes (Hotmal) since 2016, which also received a lot of opposition from the municipality of Hadera.
Through attorney Amir Birnbaum from the office of Ofer Shapir & Co., the municipality claims that it is a plan Covering a vast area, essential for determining the character of the city of Hadera for the following decades, and characterized by unusual complexities.
According to her, the provisions of the plan contradict the provisions of the city's general plan (Had/2020), which designates this area as agricultural land and also changes the provisions of the district outline plan for the district of Haifa, where the area in question is marked as an agricultural area / open landscape, outside the scope of Hadera's urban development.
Furthermore, the municipality claims that the plan is planned to be in close proximity to the old Beit Eliezer neighborhood, which is characterized by detached construction, and there is a fear that its development will damage natural values and encroach on an ecological corridor.
"Raises fear of interference in election procedures"
Over the past few years, the municipality has expressed opposition to the plan on several occasions, has repeatedly presented the relevant parties with its objections to the plan, and claims that it was assured that it would not be brought up for discussion before the local authority elections.
However, about a week ago, the municipality was surprised to receive a notification about the acceptance of the plan after confirming its compliance with threshold conditions and an invitation to a hearing on its deposit on January 31, 2024.
In a petition to the High Court, the municipality claims that this is a forced hearing on the eve of an election. During an election period, when the strictness gets stricter as the election date approaches.
In particular, this concerns issues with wide-ranging implications, which go beyond the scope of current management, and in particular when it comes to a matter that is subject to public controversy.
This principle is anchored in a large number of circulars of the Director General of the Ministry of the Interior and instructions of a legal advisor to the government."
According to the municipality, the insistence of the HTML and the National Planning Headquarters to hold the discussion of the plan on 1/31 and their refusal to postpone it for a month until after the elections, raises a fear of interference in the election procedures for the mayor and the municipal council, while forcing a discussion on the fateful plan that is in public controversy."
