Amazon and BMW Group have won the first civil case in Spain against four local fraudsters who attempted to sell counterfeit car parts and accessories across Europe.
The ruling from the European Union Trademark Court in Alicante found that the criminals had broken the law, breached Amazon policies and infringed BMW Group trademarks by trying to sell counterfeit products, including valve caps, badges and key rings.
The e-commerce group announced this in a note explaining that to manage the case, Amazon closed the defendants' sales accounts, eliminated the counterfeit product listings linked to the case and proactively refunded the customers involved.
Amazon's dedicated unit, set up to identify and dismantle counterfeiting organisations, worked closely with BMW and filed a joint lawsuit against the scammers.
“This ruling is a significant victory. By working collaboratively with brands like the BMW Group, we can successfully block counterfeiters and prevent counterfeit items from reaching our customers or being sold elsewhere in the supply chain,” said Kebharu Smith, director of the anti-counterfeiting unit. of Amazon “We are proud of what we have been able to accomplish together so far to keep customers safe from bad actors and are motivated to continue working closely together to achieve lasting impact,” explained Jochen Volkmer, Head of Intellectual Property Law, Trademarks and Design by BMW.
