The Barcelona Court has summoned the former FC Barcelona footballer to inform him of the sentence in the trial for the alleged rape of a 23-year-old girl at the Sutton nightclub.

The resolution, issued by Section 21 of the Barcelona Court, comes just two weeks after the last session of a trial in which Alves defended his innocence and assured that he had consensual sex with the girl.

The Prosecutor's Office, on the other hand, requests nine years in prison for the Brazilian player for a crime of sexual assault, a request that the private prosecution raises to 12 years.

The court has summoned all the parties present in the process, including the accused, who has remained in provisional detention in this case since January 20, 2023.

That day, the player was arrested and taken before the investigating judge, where he offered up to three different and contradictory versions of what happened in the bathroom of a Sutton booth: he first said that he did not know the young woman;

then, that nothing happened between them;

Finally, he said that the young woman performed fellatio on him.

Only three months later, in April and with the intention of leaving prison at all costs, he said that he had maintained those versions to save his marriage and recounted what the evidence collected by the Mossos had already shown: that there had been penetration.

While the victim claims that she was raped violently, Alves claims that they were consensual relations.

The trial was held for three days in February and the media were only able to follow it partially.

The victim's statement was held behind closed doors by order of the court (to protect her privacy) and the images captured by the surveillance cameras in Sutton's private rooms were not seen either.

According to Alves' defense, the victim's statement about what happened in that space (moments before the attack) does not match what the images show.

That is the defense's main asset: to discredit the victim's statement as much as possible so that the magistrates consider that it is not solid enough evidence to be the pillar of a conviction.

The Prosecutor's Office, on the other hand, defends that the victim's statement is absolutely credible and highlights the psychological consequences she suffers as proof that she was sexually assaulted.

The accusation emphasizes Alves' contradictions throughout the procedure, which were the main reason why she was placed in provisional prison, where she has now been for a year and a month.

This Thursday, the player will be driven in a police van from the Brians prison to the Palace of Justice, in the center of Barcelona.

Along with the sentence, the court will resolve the request for provisional release that, on the last day of the trial, was raised by the footballer's defense lawyer, Inés Guardiola.

The lawyer asks for her client's acquittal, but proposes an alternative scenario: in the event that the court considers him guilty, she requests that two mitigating circumstances be applied that would allow her to reduce the sentence: reparation for the damage (for having paid the 150,000 euros of compensation requested by the Prosecutor's Office) and drunkenness because, as he declared, he was under the influence of alcohol that night.
